1. ABOUT THESE TERMS
1.1 Introduction
These Terms and Conditions ("Terms") govern your use of the BrewRun mobile application, website, and services (collectively, the "Platform") operated by One More Espresso Ltd (Company No. 16854702), a company registered in England and Wales with its registered office at 75 Royal Court Drive, Bolton, BL1 4AZ ("BrewRun", "we", "us", or "our").
1.2 Acceptance of Terms
By accessing or using the Platform, you confirm that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- You accept and agree to be bound by these Terms
- You have read and understood our Privacy Policy
1.3 Updates to Terms
We may update these Terms from time to time. We will notify you of any material changes via email or through the Platform. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
2. THE BREWRUN PLATFORM
2.1 Our Service
BrewRun provides a technology platform that connects independent coffee vendors ("Vendors") with customers seeking to pre-order beverages and food items. We facilitate the connection and communication between you and Vendors but are not a party to the actual sale transaction.
2.2 Role as Marketplace
Important Notice: BrewRun operates as a marketplace facilitator. When you place an order:
- The contract for the sale of products is directly between you and the Vendor
- Payment is processed directly to the Vendor through our payment partner, Stripe Connect
- We do not handle, store, or process your payment card details
- We are not responsible for the quality, safety, or legality of products sold by Vendors
2.3 No Agency Relationship
Vendors are independent businesses and are not employees, agents, or representatives of BrewRun. We do not control and are not responsible for the conduct of Vendors or the products they sell.
3. REGISTRATION AND ACCOUNT
3.1 Account Creation
To use certain features of the Platform, you may need to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your account credentials secure and confidential
- Accept responsibility for all activities under your account
- Immediately notify us of any unauthorised use
3.2 Account Suspension or Termination
We reserve the right to suspend or terminate your account if:
- You breach these Terms
- You provide false or misleading information
- You engage in fraudulent or illegal activities
- Your conduct may harm other users, Vendors, or BrewRun
4. ORDERING AND FULFILMENT
4.1 Placing Orders
When placing an order through the Platform:
- You are making an offer to purchase from the selected Vendor
- All orders are subject to acceptance by the Vendor
- The contract is formed when the Vendor confirms your order
- You must collect your order at the specified time and location
4.2 Order Information
You are responsible for ensuring that:
- All order details are correct before submission
- You provide accurate contact information
- You specify any allergies or dietary requirements
- You arrive for collection within the designated timeframe
4.3 Pricing and Payment
- All prices are displayed in GBP and include VAT where applicable
- Prices are set by individual Vendors and may vary
- Payment is processed at the time of order placement
- Platform fees may apply and will be clearly displayed
- Tips for Vendors are optional and processed separately
4.4 Order Modifications and Cancellations
- Orders cannot be modified once submitted
- Cancellation policies are set by individual Vendors
- Refunds for cancelled orders are subject to the Vendor's policy
- We will facilitate communication regarding cancellations but are not responsible for refund decisions
4.5 Collection and No-Shows
- You must collect orders at the specified time
- Uncollected orders may not be eligible for refunds
- Vendors may dispose of uncollected orders after a reasonable time
- Repeated no-shows may result in account restrictions
5. PAYMENT PROCESSING
5.1 Payment Service Provider
All payments are processed through Stripe Connect, our third-party payment service provider. By making a payment, you agree to Stripe's terms and conditions.
5.2 Payment Security
- We do not store or have access to your full payment card details
- All payment information is encrypted and processed securely
- You are responsible for any charges or fees imposed by your bank
5.3 Refunds and Disputes
- Refund requests must be directed to the relevant Vendor
- We will assist in facilitating communication but cannot guarantee refunds
- Payment disputes should be raised with your card issuer if not resolved with the Vendor
6. USER CONDUCT
6.1 Acceptable Use
You agree not to:
- Use the Platform for any illegal or unauthorised purpose
- Interfere with or disrupt the Platform's operation
- Attempt to gain unauthorised access to any systems
- Impersonate any person or entity
- Harass, abuse, or harm other users or Vendors
- Submit false reviews or ratings
- Engage in any form of automated data collection
6.2 Content Standards
Any content you submit (including reviews and feedback) must:
- Be accurate and truthful
- Not be defamatory, offensive, or inappropriate
- Not infringe any third-party rights
- Comply with applicable laws and regulations
7. INTELLECTUAL PROPERTY
7.1 BrewRun Property
All intellectual property rights in the Platform, including the BrewRun name, logo, and content, are owned by or licensed to us. You may not use our intellectual property without prior written consent.
7.2 User Content License
By submitting content to the Platform, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, and display such content for the operation and promotion of our services.
8. LOYALTY PROGRAMME
8.1 Programme Participation
- Participation in loyalty programmes is subject to additional terms
- Points have no cash value and cannot be transferred
- We reserve the right to modify or terminate loyalty programmes
- Unused points may expire according to programme rules
9. LIABILITY AND DISCLAIMERS
9.1 Service Availability
The Platform is provided "as is" and "as available". We do not guarantee:
- Uninterrupted or error-free operation
- Availability of specific Vendors or products
- Accuracy of Vendor information or inventory
9.2 Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to £100 or the amount paid by you in the last 12 months, whichever is lower
- We are not responsible for the acts or omissions of Vendors
9.3 Product Liability
- Vendors are solely responsible for their products
- Any issues with food quality, safety, or allergens should be addressed directly with the Vendor
- We are not liable for any illness, injury, or damages resulting from products purchased through the Platform
9.4 Indemnification
You agree to indemnify and hold BrewRun harmless from any claims arising from:
- Your use of the Platform
- Your breach of these Terms
- Your violation of any laws or third-party rights
10. DATA PROTECTION
10.1 Privacy Policy
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with UK GDPR and the Data Protection Act 2018.
10.2 Communications
By creating an account, you consent to receiving:
- Transactional communications about your orders
- Important service updates
- Marketing communications (with opt-out option)
11. DISPUTE RESOLUTION
11.1 Complaints Procedure
If you have a complaint:
- First, try to resolve the issue with the relevant Vendor
- Contact our support team at hello@brewrun.app
- We will investigate and respond within 14 days
11.2 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11.3 Alternative Dispute Resolution
EU/UK consumers may access the Online Dispute Resolution platform at https://ec.europa.eu/odr
12. GENERAL PROVISIONS
12.1 Entire Agreement
These Terms constitute the entire agreement between you and BrewRun regarding the use of the Platform.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
12.3 Waiver
No waiver of any term shall be deemed a further waiver of any other term.
12.4 Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.
12.5 Third-Party Rights
These Terms do not create any third-party beneficiary rights.

14. DEFINITIONS
- "Consumer" means an individual using the Platform to purchase products
- "Order" means a request to purchase products from a Vendor
- "Platform" means the BrewRun app, website, and related services
- "Products" means beverages, food, and other items offered by Vendors
- "Vendor" means an independent business offering products through the Platform
By using the BrewRun Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
